Summary: 

On 7 November 2013, the Western Australian Land Authority, trading as LandCorp, referred a proposal to the Environmental Protection Authority (EPA), which was described in the referral as the Subdivision of Lot 500 Patterson Road, East Rockingham. Included in the referral was a request that the EPA declare the proposal to be a derived proposal under section 39B of the Environmental Protection Act 1986 (EP Act) (section 39B Declaration).

The EPA considered the proposal and the request and on 28 January 2014 notified the Minister for Environment of a section 39B Declaration. Accordingly, pursuant to section 45A(2) of the EP Act, Ministerial Statement 863 published on 26 May 2011, as it relates to the derived proposal takes effect. This is the section 45A Notice Statement 863 No. 1 of the taking of effect of Ministerial Statement 863 as it relates to the derived proposal.

On 28 November 2014, the Environmental Protection Authority (EPA) received the referral of a proposal from the Western Australian Land Authority, trading as LandCorp, for the Subdivision of Lot 21 Alumina Road, East Rockingham. Included in the referral was a request that the EPA declare the proposal to be a derived proposal under section 39B of the Environmental Protection Act 1986 (EP Act) (section 39B Declaration).

Included in the referral was a request that the EPA declare the proposal to be a derived proposal under section 38E of the Environmental Protection Act 1986.

The EPA considered the proposal and the request and on 27 June 2022 notified the Minister for Environment of a section 38E Declaration. Accordingly, pursuant to section 45B(2) of the EP Act, the Minister for Environment issued the section 45B Notice 4 of the taking effect of Ministerial statement 863, published on 26 May 2011, as it relates to the derived proposal. On 30 August 2023, the Environmental Protection Authority (EPA) received the referral of a proposal from Western Australian Land Authority trading as DevelopmentWA to develop undeveloped land in the Rockingham Industrial Zone, located approximately 40 kilometres south of Perth, in the City of Rockingham and City of Kwinana. Included in the referral was a request that the EPA declare the proposal to be a derived proposal under section 38E of the Environmental Protection Act 1986.

The EPA considered the proposal and the request and on 20 December 2023 notified the Minister for Environment of a section 38E declaration. Accordingly, pursuant to section 45B(2) of the EP Act, the Minister for Environment issued the section 45B Notice 5 of the taking effect of Ministerial statement 863, published on 26 May 2011, as it relates to the derived proposal.
