Details: In December 2007, the Environmental Protection Authority provided advice to the Minister for the Environment in Report 1276 about the Ministerial conditions that should be applied to Magellan Metal's proposal to transport lead carbonate concentrate in sealed bags and in locked containers for export through the Port of Fremantle.
However, on State Solicitor's Office advice, the decision to change the proposal from transport and export of bulk lead carbonate through the Port of Esperance, to containerised transport and export through the Port of Fremantle, should be made first.
In accordance with that advice and acting under pre-existing, delegated authority from the Minister for Environment, I have approved the change in the proposal to allow the transport and export of containerised lead carbonate in sealed bags through the Port of Fremantle.
I gave that approval on the basis that there is no significant, detrimental effect associated with the revised proposal that is different from or additional to, the original proposal.
The Acting Minister for Environment, John Day, then sought the EPA's further advice on a set of Ministerial conditions that were developed following consultation with decision making authorities and with the advice of the State Solicitor's Office.
In that advice provided to the Acting Minister in Report 1314, the EPA concluded that the proposed conditions, with the EPA's recommended changes, are appropriate and provide greater certainty that the proposal can be managed to meet the EPA's objectives.
