Bilateral agreement made under section 45 of the Environment Protection and Biodiversity Conservation Act 1999 (Cth) relating to environmental assessment
Summary:

This bilateral agreement accredits the Environmental Protection Authority’s Public Environmental Review (PER) and Assessment on Proponent Information - Category A (API-A) levels of assessment. The agreement also accredits the clearing permit assessment process under Part V Division 2 of the Environmental Protection Act 1986.

Accreditation of the EPA’s assessment processes means that the Commonwealth can rely on environmental assessments undertaken by the EPA for the purpose of its approval decisions under the EPBC Act on proposals that are likely to have a significant impact on a matter of national environmental significance. If the EPA assesses a proposal at the level of PER or API-A under the agreement, separate assessment by the Commonwealth is not required.

This agreement, which will come into force on 1 January 2015, differs from the previous bilateral agreement in that it accredits the EPA’s API-A and PER levels of assessment as well as the clearing permit assessment process under Part V of the EP Act.

Agreement between the Commonwealth of Australia and the State of Western Australia
Summary:

The bilateral agreement between the Commonwealth and the State of Western Australia relating to environmental assessment (the bilateral agreement), which was entered into on 16 August 2002, allows the Commonwealth Minister for Sustainability, Environment, Water Population and Communities to rely on specified environmental impact assessment processes of the State of Western Australia in assessing actions under the Environment Protection and Biodiversity Conservation Act 1999 (the EPBC Act).

On 16 July 2013, the bilateral agreement was amended to accredit assessment by public environmental review under the Environmental Impact Assessment (Part IV Divisions 1 and 2) Administrative Procedures 2012 (WA), which replaced the 2010 procedures. The amendments also corrected some inconsistencies in references to the EPBC Act.

Agreement between the Commonwealth of Australia and the State of Western Australia
Summary:

This bilateral agreement allows the Australian Government Minister for Sustainability, Environment, Water, Population and Communities to rely on specified environmental impact assessment processes of the State of Western Australia in assessing actions under the Environment Protection and Biodiversity Conservation Act 1999.

In 2010, Western Australian environmental legislation was amended and included the implementation of a new form of Environmental Impact Assessment (EIA) process. This resulted in the development of this replacement bilateral agreement to accredit the new Western Australian EIA process.
