Shire of Murray Town Planning Scheme No. 4 Amendment 104 (Point Grey) - Review of Ministerial Statement 519
Summary:

This report provides the EPA’s advice to the Minister for the Environment under section 16(e) of the EP Act. The outcome of the EPA’s review of Statement 519 is that the environmental conditions are not required because:

(a) provisions reflecting the requirements of the conditions in Statement 519 are included in Amendment 104 (as modified); and

(b) the extent of the land to be rezoned in Amendment 104 (as modified) has been reduced. Relevant environmental factors such as caves (Ministerial Condition 7) and wetlands (Ministerial Condition 9) are no longer present within the area which is the subject of Amendment 104 (as modified).

Strategic Environmental Advice on the Dawesville to Binningup Area

Advice on Conservation Values and Review of Nature Reserve Proposals in the Lake Cronin Region
Summary: This document was developed as a result of advice requested in November 2004 by the Minister for the Environment from the EPA under Section 16(e) of the Environmental Protection Act (1986).
In 1975, the EPA recommended "that Lake Cronin and an adequate area around the lake should be made a Class 'A' reserve for the Conservation of Flora and Fauna, to be vested in the WA Wild Life Authority" (recommendation 11.10, EPA 1975).
Due to competing interests, only a small area consisting of 1015 ha around the lake was gazetted as a formal Nature Reserve in 1980. Henry-Hall (1990) reviewed the values of the area and recommended that the values could best be protected by the establishment of a large reserve consisting of approximately 113,250 ha.

Kimberley LNG Precinct
Summary: Review of potential sites for a proposed multi-user liquefied natural gas processing precinct in the Kimberley region. Advice of the Environmental Protection Authority (EPA) to the Minister for Planning (as the Minister for Environment's delegate) under Section 16(e) of the Environmental Protection Act 1986.

The purpose of this report is to provide the EPA's early environmental advice in relation to the Western Australian Government's site evaluation process for a multi-user liquefied natural gas (LNG) processing precinct to process gas resources from the Browse Basin. This advice has been requested by Government and is provided in accordance with Section 16(e) of the Environmental Protection Act 1986 (the EP Act). There is no appeal period on s16(e) advice.

Keralup formerly Amarillo Masterplan, Karnup
Summary: This report provides the Environmental Protection Authority's advice to the Minister for the Environment under section 16(e) of the Environmental Protection Act 1986 on the project by the Department of Housing and Works (DHW) to develop a new town site at Amarillo, a farming property in Karnup. Amarillo has subsequently been renamed Keralup. The project covers 4000 hectares in the single ownership of the DHW and lies 17km south east of Rockingham and 10km north east of Mandurah. If developed, the area would become a fully integrated urban community housing up to 90 000 people.

Fire Management in the Kimberley and other Rangeland Regions of Western Australia
Summary: The Environmental Protection Authority (EPA) considers biodiversity conservation to be a priority for fire management, and second only to protecting human life, to prevent major environmental degradation. Taking into account the available data, the EPA has come to the conclusion there is enough evidence to justify urgent action being taken to prevent further loss of the biodiversity values of the Rangeland regions.

Cumulative impacts of oxides of nitrogen emissions from existing and proposed industries, Burrup Peninsula Section 16 advice - no appeals
Summary: This report provides the Environmental Protection Authority’s (EPA’s) advice and recommendations to the Minister for the Environment in response to a request from the Minister to provide advice under Section 16(e) of the Environmental Protection Act 1986 (the Act). Advice was requested on the impact of cumulative air emissions, particularly oxides of nitrogen (NOx), on the Burrup Peninsula environment and on whether a review of conditions previously issued should be undertaken under Section 46 of the Act. However, the EPA has not considered the potential effects of NOx on the integrity of Aboriginal Rock Art on the Burrup Peninsula. There is an expert committee which has been established by the Department of Industry and Resources and reporting to the Minister for State Development which is specifically considering the issue.

Environmental Advice on the Principle of Locating a Gas Processing Complex on Barrow Island Nature Reserve
Summary:

Barrow Island is a class A Nature Reserve situated about 70km off the Pilbara coast of Western Australia. The waters around Barrow Island have recently been proposed for reservation as part of a Barrow-Montebello Islands Marine Conservation Reserve.

In February 2003 the Gorgon Venture released the “Environmental, Social and Economic Review of the Gorgon Gas Development on Barrow Island” for a six week public submission period. The document describes the proposal, puts the case for the use of Barrow Island for the process plant facility and discusses the likely associated environmental, social and economic issues. Public submissions on the environmental aspects of the ESE Review were received by the EPA, on behalf of the Standing Interagency Committee of CEOs. ChevronTexaco responded to the submissions, and the whole of government evaluation phase of the project commenced. A summary of the submissions and ChevronTexaco’s responses can be found at www.epa.wa.gov.au and www.gorgon.com.au. A list of submitters names is attached to this report at Appendix 4.

A strategic level process is designed to guide and assist in the making of an in-principle decision by Government. This report is the environmental contribution to the Government’s strategic economic, social and environmental assessment of a proposal to locate a gas processing complex on Barrow Island. Part A provides the EPA’s advice on access to Barrow Island for industry. Should Government decide to agree to access, Part B provides the EPA’s recommendations on managing the environmental issues that would arise. Formal environmental assessment would still be necessary under the provisions of Section 38 of the Environmental Protection Act and the Commonwealth Environment Protection and Biodiversity Conservation Act.

This report has been released, together with those by the Department of Industry and Resources and its consultant, Allen Consulting Group, and the Conservation Commission, for six weeks, to give the public full access to the environmental, social, economic and strategic advice available to Government about the Barrow Island proposal. This period provides the opportunity for public comment before Government makes an in-principle decision. Summary: The Griffin Coal Mining Company (‘Griffin’) is proposing to develop the Ewington I open-cut coal mine (“Ewington I”). The mine, which is located approximately 4 km east of Collie, was approved by a previous Minister for the Environment in September 1992. Environmental values associated with the alignment of Roe Highway Stage 8 No Appeals
Summary: Following a request from the Minister for Planning and Infrastructure, the Minister for the Environment and Heritage sought advice from the Environmental Protection Authority (EPA) in late August 2002 pursuant to Section 16(j) of the Environmental Protection Act 1986 in relation to the alignment for Stage 8 of Roe Highway. Specifically, the Minister for the Environment and Heritage sought the EPA’s confirmation of the environmental values that would be impacted if Stage 8 of Roe Highway were to be constructed.

This EPA report provides environmental advice on the key environmental values associated with the alignment of Roe Highway Stage 8 and likely impacts arising if construction was undertaken.

Strategic Planning for Future Power Generation - Pinjar Power Station Expansion, Kwinana/East Rockingham Power Station, Kemerton Power Station, New Bunbury Power Station and Collie Power Station Expansion. No appeals
Summary: Western Power Corporation has requested early advice on any constraints which may be “fatal flaws”, from an environmental impact perspective, which may apply to the installation of power generation facilities at sites at Pinjar, Kwinana, Kemerton, Bunbury and Collie. The proponent’s intent is to have an array of sites on which power providers could propose new power stations. It is not proposed that all sites would be used in the near future and any proposal for a specific site would be subject to more detailed assessment under s38 of the Environmental Protection Act 1986.

This report provides the Environmental Protection Authority’s (EPA’s) advice and recommendations to the Minister for the Environment and Heritage on the environmental factors relevant to the proposal. Section 16(e) of the Environmental Protection Act 1986 enables the EPA to advise the Minister for the Environment and Heritage on the environmental protection aspects of any proposal or scheme, and on the evaluation of information relating thereto.

The EPA developed, in consultation with Alcoa, and the then departments of Conservation and Land Management (CALM) and Resources Development, a process to review plans by Alcoa to disturb CAR Informal Reserves within ML1SA. This process is consistent with the requirements of the RFA and the Environmental Protection Act 1986. There are no appeals on s16 advice.
