Public comment on referrals


The Approval and Related Reforms (No 1) (Environment) Act 2010 amended the Environmental Protection Act 1986 (EP Act) to streamline the approvals process for development proposals.

Some of the appeal provisions of the EP Act were amended, however appeal provisions remain on:

  • the EPA’s decision to ‘not assess’ a proposal unless the EPA states that it requires a native vegetation clearing permit, and
  • the EPA report to the Minister for Environment.

In order to ensure that transparency and accountability are retained, new referrals received by the EPA are available for public comment for a period of seven days (closing at midnight (WST) after seven days).

Members of the public are invited to provide comments to the EPA on any new referral, to help the EPA make its decision whether or not to assess the proposal and, if it is to assess, the level of assessment.
