Magellan Lead Carbonate Project, Wiluna – to facilitate the export of containerised lead from the Port of Fremantle, change to environmental conditions

Summary:

This report provides the advice of the EPA to the Minister for environment under Section 46(1) of the Environmental Protection Act 1986 (EP Act) on Ministerial Conditions 559, as amended by Statement 783, imposed on Magellan Metals Pty Ltd (Magellan) on 2 February 2009.

On 23 February 2011 the Minister for Environment imposed Interim Implementation Conditions on Magellan under Section 45B of the EP Act in order to strengthen the auditing, monitoring and reporting requirements of the project to allow Magellan to resume the transportation of lead carbonate concentrate, following a stop order that was issued on 31 December 2010. The Interim Implementation Conditions superseded Ministerial Statement 559 and 783 and are effective until the completion of this review and the Minister deciding on the conditions that the proposal will be subject to.

Town of Port Hedland Town Planning Scheme No. 5 Amendment 22: Rezone Residential Land in the West End of Port Hedland

Summary: The Town of Port Hedland, the Responsible Authority, initiated Amendment 22 to its Town Planning Scheme No.5 (TPS5) in June 2009. Amendment 22 arose out of recommendations from the Town of Port Hedland’s Land Use Master Plan (LUMP) (Town of Port Hedland, 2008). These recommendations include reducing the potential for human exposure to dust.

The Environmental Protection Authority (EPA) set the level of assessment as ‘Scheme Assessed – Environmental Review’ in September 2009. The EPA determined that Amendment 22 warranted formal assessment due to the level of uncertainty of increasing residential density in an area recognised as having air quality (dust) levels that often exceed national standards.

This report provides the EPA's recommendations to the Minister for Environment on the proposed scheme amendment.

Shire of Murray Town Planning Scheme No. 4 Amendment 104 (Point Grey) - Review of Ministerial Statement 519

Summary:

This report provides the EPA’s advice to the Minister for the Environment under section 16(e) of the EP Act. The outcome of the EPA’s review of Statement 519 is that the environmental conditions are not required because:

(a) provisions reflecting the requirements of the conditions in Statement 519 are included in Amendment 104 (as modified); and

(b) the extent of the land to be rezoned in Amendment 104 (as modified) has been reduced. Relevant environmental factors such as caves (Ministerial Condition 7) and wetlands (Ministerial Condition 9) are no longer present within the area which is the subject of Amendment 104 (as modified).

Happy Valley Titanium Minerals Project

Summary: This report provides the Environmental Protection Authority’s advice and recommendations to the Minister for Environment on Bemax Resources Limited’s proposal to develop a mineral sand mining proposal that is located in the Shire of Capel on the Whicher Scarp, 10 km south of the town of Boyanup. The two deposits (northern and southern) contain over 750,000 tonnes of recoverable heavy mineral concentrate and will be mined using open cut, dry mining techniques involving heavy earthmoving equipment and processed through screening and separation plants. This proposal will involve the clearing of 146 ha of native vegetation.
